Sarah Palin Demands Arnold Veto Port Clean Air Bill

The day before she was announced as John McCain’s vice presidential pick, Alaska Governor Sarah Palin called on Arnold Schwarzenegger to veto a landmark bill that would levy fees on cargo containers at state ports to raise money for pollution mitigation standards. The air around California ports, especially LA-Long Beach, is among the worst in the nation with major negative health impacts on nearby residents. But Palin doesn’t care:

“Enactment of Senate Bill 974 will have negative impacts on both Alaska and California,” Palin wrote. “For Alaskans, a very large percentage of goods [90% or more] shipped to Alaska arrive as marine cargo in a container.”

Palin said many Alaskan communities lack road access and depend entirely on goods shipped by container, something that has significantly increased in cost in recent years. Many of those containers pass through the Los Angeles and Long Beach ports before arriving in Alaska, and Palin argues that the fee will add even more to the cost of goods shipped to her state.

“This tax makes the situation worse,” Palin wrote. “Similarly, the tax may harm California by driving port business away from its ports.”

The letter concludes by requesting that “due consideration be given to our state and that you not sign Senate Bill 974.”

State Sen. Alan Lowenthal, author of SB 974, had a devastating response to Palin’s interference:

On Thursday, with the Palin letter hitting the Internet, Lowenthal invited the Alaskan governor to travel to the Southern California ports to see first-hand why the fee is needed.

“We are losing about 3,400 Californians each year because of pollution,” Lowenthal said. “No matter what Gov. Palin would like to see happen, the impact is killing Californians. I don’t think Gov. Palin truly understands the impacts going on here.”

Two mothers who live near the port of LA-Long Beach would probably like Palin to understand what some of those impacts are:

RUMBLE, RUMBLE. That’s the hum of my community, so close to the nation’s largest port complex. The air tickles your throat, but my daughter and I are not laughing. We’ve been living in Long Beach for ten years. The doctor first diagnosed her with asthma when she was six. It’s been traumatizing to watch my child suffer. Through my involvement with the Long Beach Alliance for Children with Asthma, I’ve learned about managing my child’s asthma, including controlling triggers inside the home. Unfortunately, it’s impossible to control the environment outside, when you live next to the largest fixed source of air pollution in greater Los Angeles. I believe there are solutions to these problems. I don’t believe industry’s claim that reducing pollution will hurt our economy. These companies make a lot of money while I spend money on medicine and miss work and my daughter misses school.

I LIVE NEAR I-710: a parking lot of nearly 50,000 cargo trucks daily. Next door is Wilmington, an area pockmarked with refineries. We get hit with pollution from all sides. My youngest son was born with a closed trachea and his left vocal cord paralyzed; he still takes speech classes. He also suffered from severe asthma attacks. I had to medicate him and connect him to a breathing machine, feeling desperate that my child couldn’t breathe.

This is what Palin, for whom motherhood is such a central part of her message and appeal, is enabling with her effort to squelch California’s clean air laws – Palin is supporting pollution that is hurting working families.

Her interference in California’s lawmaking process is bad enough, but it’s a harbinger of what we can expect from a McCain-Palin Administration. As we saw with the EPA waiver the federal government has the power to preempt California clean air rules, and Palin is signaling that if she and McCain win they will likely use that power to undermine our efforts to provide healthy lives for our families.

California may not have the same role to play in the election that swing states like Nevada and Ohio do, but we can help Americans understand exactly what they’ll be getting from McCain-Palin – more of the same attacks on our health, our environmental laws, and our states rights.

CA-46: LCV Endorses Debbie Cook

Los Angeles, CA-The California League of Conservation Voters (CLCV) announced today their endorsement of Debbie Cook, the Democratic nominee for Congress in the 46th Congressional District.

“We’re proud to support Debbie Cook because she has shown time and again her commitment to protecting our coastal resources,” said CLCV’s Southern California Director David Allgood. “Mayor Cook has a long record of achievement on environmental, public health and other issues important to the people of the 46th District.”

In 1989, rather than see her city’s parks and beaches destroyed by private development, Cook led a group that collected 18,000 signatures for a successful ballot measure to require voter approval in order to build in Huntington Beach public parks and beaches.

After attending law school, she joined the Bolsa Chica Land Trust legal team, winning a case that protects sensitive coastal habitat throughout California to this day. As Mayor of Huntington Beach, she led the fight to stop the Orange County Sanitation District from dumping partially-treated sewage into the ocean, resulting in cleaner water for our beach’s recreational users.

Cook’s opponent, longtime Congressman Dana Rohrabacher, ignores science to deny that climate change is man-made, favors drilling off the coast of California and has spoken against the landmark Clean Trucks Program at the Ports of Long Beach and Los Angeles – which will slash toxic truck emissions by 50%, significantly reducing the port-related diesel pollution that leads to 2,400 premature deaths per year, according to the California Air Resources Board. He currently has a low 10 percent rating on the League of Conservation Voters’ congressional scorecard.

It’s not surprising that Cook would get the endorsement; what’s crucial here is whether or not she becomes a cause for the environmental movement the way that Jerry McNerney became a cause in 2006.  Rohrabacher’s rejection of port cleanup, which just passed the California State Senate, could be a really salient issue in this district, part of which covers Long Beach and most of which is situated on the coast.  Some hard-hitting ads and mailers accusing Crazy Dana of allowing kids to suffer and die from pollution seem to be in order.

UPDATE: Cook is also pivoting off of the historic nominating speech by Barack Obama at the DNC, holding 200 “Making History” parties in the district and raising money for Cook’s campaign.  This is really a local effort.  You can sign up at her website.

Perspective on The Governor’s Budget Gambit – Pure Cruelty

With this epic FAIL maneuver on the budget, Arnold Schwarzenegger signaling here that his little state employee wage cut gambit didn’t work.  It didn’t produce the kind of compromise he wanted and it sent him tumbling in the polls as he attempted to cynically hold innocent bystanders hostage in an unrelated fight.  So he had to cut off all bills instead.  Maybe now, he thinks, the legislators will take notice.

But let’s understand what he’s doing here.  Yesterday, as a culmination of four years of work, Alan Lowenthal’s bill to clean up the ports of Oakland, LA and Long Beach passed the State Senate.  Eliminating the toxic pollution at the ports would save 3,700 lives annually according to the California Air Resources Board.  The bill would enact a $30 container fee on every import, using that money ($300 million annually) for investment in reducing pollution and improving freight rail.  It’s a milestone bill that is sorely needed to improve the air quality of these communities.

It’s not an exaggeration to say that Arnold’s latest stunt will actually kill thousands of people from reversible diseases.

There’s a bill pending in the Senate Appropriations Committee authored by Fiona Ma (AB 2716) which would deliver guaranteed paid sick days to all California workers.  This bill has the support of 73% of the public and would make the state the first in the nation to provide this to their residents.  Arnold would rather stamp his feet and issue ultimatums than improve the lives of Californians and do the bidding of the overwhelming majority of the public.

On health care, while we cannot expect a comprehensive plan to come out of this legislative session, there is a deal coming together that would improve health care for those who have insurance by mandating some strict rules for the industry:

In the final weeks of the legislative session, they are negotiating measures that would limit insurer profits on individual plans, require plans to provide a minimum set of benefits and restrict insurers’ ability to cancel policies retroactively […]

Three million Californians buy health insurance on their own rather than through employers. Insurers keep premiums low — and profits high, their critics say — on some individual policies by limiting the services they cover. Such plans may exclude prescription drugs and maternity services, for example; others may cover only hospital visits.

Many of the policies have big deductibles and require patients to pay large portions of their expenses, costing them much more than coverage obtained at workplaces.

The game-playing by Arnold on the budget means that, in all likelihood, these rules will not go into effect, and individual consumers of health insurance (like me) will remain incredibly vulnerable to the vicissitudes of the insurance industry, which has shown already a penchant to deny coverage and jack up premiums.  That too will put the lives of Californians at risk.

There’s a human cost to the bullshit that Terminator Boy isn’t accounting for.  His head is in the clouds, and he thinks he can bully the legislature liked he bullied people in scripted movies for decades.  But the recklessness will cost money, pain, suffering, and even lives.

Teamsters & Turtles Target POLA/POLB

During the Seattle WTO protests, in 1999, the phrase “Turtles & Teamsters, Together At Last” (and variations) jumped from protest sign to guiding philosophy. It symbolically described hundreds of thousands Sierra Club activists (who dressed as sea turtles) and union members who marched to demand that human and environmental concerns be included in discussions of global Free Trade regimes.

“Turtles & Teamsters” also put a name to the increasingly common alliances between environmentalists and labor unions, which were no longer willing to accept that protecting the environment and jobs were mutually exclusive conditions. That potent alliance has formed around the ports of Los Angeles and Long Beach, and offers both hope and dangers.

In August 2006, Teamster reps at YearlyKos told me the Brotherhood “basically got kicked out of the ports when the trucking industry was deregulated and hiring owner-operators became the standard MO for the industry. The Teamsters ominously said that they were already laying to ground work to reorganize drayage drivers and ‘we’ll be back’.” (LBP 10/19/2006) The following October, Governor Schwarzenegger vetoed a bill that would have granted collective bargaining rights to drayage drivers, for the second year in a row. The March 29th edition of the Daily Breeze showed a mob of owner-operators at a Coalition for Clean and Safe Ports rally. Careful observers noted that each of the enthusiastic port truck drivers wore a green fleece with a Teamsters‘ emblem on the breast, but that not one of them was legally allowed to join the union.

It’s the irony in that picture that forshadows an explosive political conflict in the coming months and years. The CCSP has proposed that the Ports limit access to pre-approved companies and their employees, a local-level policy change which would make an end-run around Sacramento. The change would radically alter the labor relations by ending the ‘independent contracting’, provide a mechanism for enforcing vehicle efficiency upgrades and shore up TSA security initiatives. It would also inevitably (and substantially) raise the cost of moving freight, which means the world’s largest retailers and manufacturers will not be gentle.

In the short term, shippers will probably be able to keep the Ports from implementing the CCSP’s proposals, but it comes with a risk. Teamsters are famous for their militancy and port truckers have been known to stage their own independent direct actions (i.e. shutting down the I-5 with a single abandoned truck). This is the beginning of an election cycle which many expect to obliterate the Republican Party, and an energized Democratic Party is looking at every conceivable cause to grow and activate its base. Allowing tens of thousands of immigrant truck drivers to unionize will be an easy issue support for Democratic insurgents, and an easy campaign promise to deliver once in power.

Toeing the line and refusing to negotiate has been a reliable breakwater for businesses and shippers keep down costs. Logistics industry insiders, however, predict a ‘Perfect Storm’ in 2008 and truckers in Long Beach may contribute to the tsunami which threatens to wipe out the deregulated transportation industry of the last 20 years.
