He wanted to be listed on the ballot as &#8220;Assistant Attorney General&#8221; which is an actual title he has &#8211; in South Dakota. As the <a href=\"http:\/\/latimesblogs.latimes.com\/california-politics\/2010\/03\/gop-attorney-general-candidate-gets-a-job-and-ballot-title-in-south-dakota.html\">LA Times reported last month<\/a>, Eastman was given a temporary appointment as SD&#8217;s Assistant AG while working on a case.<\/p>\n<p>LA County District Attorney Steve Cooley, another Republican candidate for AG, sued to reject that ballot title. As <a href=\"http:\/\/latimesblogs.latimes.com\/california-politics\/2010\/04\/eastmans-ballot-title-nixed-by-judge.html\">Shane Goldmacher reports<\/a>, the suit was successful:<\/p>\n<blockquote><p>On Thursday, Sacramento Superior Court Judge Timothy Frawley ordered Eastman, who recently resigned as dean of Chapman University School of Law in Orange County, to be identified as a &#8220;constitutional law attorney.&#8221;<\/p><\/blockquote>\n<p>Of course, Eastman isn&#8217;t even a very good con law attorney. He is one of the wingnuts who believes the federal health care bill is unconstitutional, a view that the <a href=\"http:\/\/www.sacbee.com\/2010\/03\/28\/2636784\/nullify-health-law-good-luck-with.html\">Sacramento Bee slammed<\/a> as being a form of &#8220;nullification&#8221; which was settled by the Civil War.<\/p>\n<p>The Bee editorial also mentioned the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Supremacy_Clause\">Supremacy Clause<\/a>, which as a con law attorney, you&#8217;d think Eastman would understand.
