San Diego Still Hates Clean Elections, Sues Bowen

Now crossposted to DailyKos and San Diego Politico

Back in August, Secretary of State Debra Bowen announced that she was disallowing the majority of DRE voting machines made by Diebold and Sequoia.  Part of her move in August was to require that 10% of votes in a close election (less than one half of one percent) be counted by hand.  As a result of the potential “logistical nightmare” of having to count so many votes by hand, San Diego County has been pushing hard for people to vote by mail.  But apparently that wasn’t going quite well enough.  So now the Deborah Seiler, the San Diego County Registrar of Voters, is suing Debra Bowen over the issue.

The suit claims that counting 10% of votes by hand would create delays and extra work (boo hoo) and threaten the registrar’s ability to complete the tabulation during the 28-day canvass period after the February 5 election.  San Diego County asserts that Secretary Bowen lacks the authority to mandate such a change without providing the funds to pay for it, although Bowen spokesperson Nicole Winger says the law “clearly” gives Bowen that authority.

So what, you may wonder, makes this a particularly big issue in San Diego County?  Well, it could be that Ms. Seiler is a former Diebold saleswoman who participated in the sale of Diebold machines to San Diego in 2003?  Her deputy is confirmed election corrupter Michael Vu, who presided over illegal practices during the 2004 Ohio elections.  On top of that, once you start having to verify all these darn votes, you might have problems with letting volunteers take voting machines home overnight.  Even though having random people be granted unfettered access to voting machines seems safe.

It’s really gotta be embarrassing for folks like Deborah Seiler to be complaining about votes being counted.  Given that her job is to count votes.  Wait, you want me to potentially count more than 1% of the votes?  Who do you think I am? The Registar of Voters or something?

Diebold Voting Machines and snafus questioned in Kern County’s ’06 primary.

A reprint of my writeup about the Diebold fiasco in Kern’s 06 primary. The original can be found here:
http://tinyurl.com/2…

The state of California’s Select Committe on Integrity of Elections began holding hearings today in my city of Bakersfield. Kern county experienced significant problems during the ’06 primary, forcing some voters to become disenfranchised..Meaning they couldn’t vote. The following three areas were targeted as unacceptable. And the cause of the voter disenfranchisement and reporting problems here in Kern County:

The Voter Access Cards
Lack of paper ballots for backup if the machines failed to work
Tabulation of the votes after the polls closed.

The Voter Access Cards, or VAC’s, which activate the Diebold TSX voting machine for each voter, did not work in many precincts when the polls opened. I personally did not experience any problems, but several precincts, such as those in Delano, CA did not have any working VAC’s and people were waiting to vote when the precincts opened. The poll workers had not been trained in how to deal with this type of malfunction. They were told it wouldn’t be a problem.

But it was. And people were turned away or got tired of waiting and left without voting. A privilege and one protected by the 19th Amendment to the Constitution.

The root cause of the malfunction was determined to be old VAC’s from the previous election year that had not been updated with the new security codes. Who’s fault was this one might ask..Diebold piped up and accepted blame. But during the hearing, Diebolds California representative could not say with any certainty why Diebold dropped the ball in putting this crucial step into their training manuals sent out to Kern county, or why their representatives, who were in town on a weekly basis to the runup of the election, didn’t tell the Kern County Registrar that the VAC’s had to be re-programmed. The Diebold representative couldn’t answer most of the questions asked of him with any certainty. Neither could the Deputy Registar when it was her turn on the hotseat. The Deputy Registrar couldn’t even tell the senators how many paper ballots were cast because of the VAC malfunction. Neither individual seemed prepared for the hearing. Neither person could tell the Senators how much Kern County paid for the Diebold system that left voters out in the cold.

According to this article in the Bakersfield Californian, Kern County paid “about 5 million” for the system.

Two of the three senators conducting the hearing were Democrats. The lone Republican, Roy Ashburn however, asked many of the hard questions and didn’t accept the empty explanations and the “I don’t knows” offered by Diebold and the Registrar’s Office for the problems that occurred over the course of the election day and evening.

Some folks were given paper ballots. The county Registrar only issued 20 of these to each precinct. It should also be mentioned that Delano’s poll workers were lax in showing up to work. They had to grab folks that were not trained during the preceding months to fill in. When they ran out of paper ballots, they started giving people Spanish ballots, even if they didn’t speak Spanish. They also copied ballots and handed those out. They tried vainly to fill the need and rights of Californians to vote in an election. At one point it was mentioned during the hearing that the Registar had said she would accept “Faxed” ballots from voters. It had to be explained to the Registrar during the course of the election night that faxed ballots were not legal, and they were not accepted.

The third issue was the failure of Ridgecrest to transmit their voting results after the polls closed. Ridgecrest is over two hours away from Bakersfield. Each Diebold machine has the ability to act as a transmitter but the problem seemed to be blamed on the baud speed of the modems. The voting results had to be driven to Bakersfield, resulting in a major delay that should of never happened. The inability to transmit voting results from Ridgecrest, coupled with the processing of paper ballots led to a three hour delay in voting results after the polls closed here in California. When they did start showing results..they were being reported as “100% of precincts reporting” when in fact they had just started tabulating the votes.

Another problem in the process to tabulate the votes was the Security within the computer center for the Registrar. There was the expected panic when the numerous problems arose, however, people who had been hired for menial positions and were NOT cleared by security checks were given access to the computer room. Some were asked if they had any computer experience, and if not, would they be willing to learn. The secure computer room was no longer secure. Add to this mix, the paper ballots that were not expected to be processed because, according to several people that testified, this was never going to happen, and you had procedures that were ignored or altered after the fact.

These issues affect all voters, party affiliation has no bearing on this important issue of disenfranchisement. The three senators were Roy Ashburn, Joseph Dunn and the chair Debra Bowen. All three asked questions and participated equally. Sen. Ashburn was incensed that Ann Barnett, the Registrar, who is also our Auditor/Controller/County Clerk did not appear. He demanded to know why. He was told by Sandra Brockman, Deputy Registrar that she was “on vacation”. Sen. Dunn stated that accepting blame was easy for Diebold but providing restitution to the disenfranchised voters was no where to be found. Diebold’s representative stated they were going to pay for the helicopter needed to deliver working VAC’s to the precincts that did not have any when their polls opened that morning. This was not an acceptable response judging by the reaction of Sen. Dunn. Many of the important questions posed by the committee went unanswered. Since this is their first stop, I hope they will get answers to them somewhere down the road. Our right to vote depends on it.

Lift the Shroud of Secrecy from Electronic Voting Systems

(Welcome Assemblyman! As per our policy of bumping diaries from electeds, up this goes. This issue is particularly important given SoS Bowen’s recent revelations. I hope we can get this bill to Arnold, and get him to sign it. – promoted by Brian Leubitz)

On November 4, 2008, millions of Californians will go to their polling places to cast their votes using electronic voting machines.  By the end of that evening, we will know who will take office as our next President.  What we will not know that night – what we may never know with certainty – is whether our votes were in fact properly counted by those electronic voting machines.

More after the jump…

After the debacle of the election of 2000 focused the nation's attention on “hanging chads” in Florida, Congress passed the Help America Vote Act, which encouraged the wide use of electronic voting machines.  Since then, corporate vendors of these machines, such as Diebold, have actively promoted them throughout the country.  Many county registrars are investing heavily in this new technology in an effort to streamline the voting process, and to provide greater opportunity for some disabled citizens to vote independently.

Despite their effusive claims of security and accuracy, however, Diebold and most other manufacturers keep the actual workings of these machines a closely held secret.  Although the public has an absolute right to observe every aspect of the process of counting paper ballots, the public is completely deprived of that right with regard to electronic voting.

That is why I've authored AB 852, the Secure, Accurate and Fair Elections (SAFE) Act of 2007.  Simply stated, the SAFE Act would require public disclosure of the computer source code that runs our state's voting machines.  If a manufacturer refuses to disclose a voting system's source code for public scrutiny, that system would not be certified for use in California elections – period.  This important reform will ensure that voting rights advocates, computer scientists, the media, and any member of the public with an interest in technology and democracy, could analyze the source code and identify any potential errors or security risks.

The risks presented by the current certification process are not hypothetical.  Secretary of State Debra Bowen has completed a laudable “top-to-bottom” review of voting systems in California, and that review has produced troubling results resulting in the decertification of several of California's voting systems.  For example, the review found that some voting machines in Los Angeles County contained software that was different than the software that the manufacturer had delivered to the Secretary of State for review and analysis.  More importantly, every voting system has proven susceptible to attacks that would disable or fundamentally alter the software on the system.  Voting system vendors have no incentive to fix errors in their code as long as the law favors their business interests over our public interest in a secure democratic process.  SAFE will correct this deficiency in our democratic process.

President Kennedy once observed that “the very word 'secrecy' is repugnant in a free and open society; and we are as a people inherently and historically opposed to secret societies, to secret oaths and to secret proceedings.  We decided long ago that the dangers of excessive and unwarranted concealment of pertinent facts far outweighed the dangers which are cited to justify it.”  Certainly any secrecy concerning the manner in which our votes are counted should be repugnant to us all.  The operation of our voting systems must be open and accessible to scrutiny so that the veracity of these essential implements of our democracy is always beyond reproach.

If we don't act now, the cost could be democracy itself!  Now is the time to tell your elected officials that there has never been a better time to implement fundamental reforms to our election process.  Call, write, or email your State and Local officials and tell them to support AB 852, the SAFE Act, and take back our democracy from the voting system vendors!

Newly elected California Secretary of State Debra Bowen GETS DOWN TO BUSINESS!

Read Bowen’s CA Voter Bill of Rights

Photo Sharing and Video Hosting at Photobucket

Much to the “Elephants” fury, Debra Bowen is doing the job California voters elected her for. They’re attacking her for proving (beyond any shadow of a doubt) that several of the electronic voting systems installed in various California counties are not only vulnerable to EASY hacking, but they simply don’t work. Not only that, cheapskate county clerks and registrars across the state are whining  because they’ll probably have to replace the defective, risky systems they all bought from Diebold, Sequoia, Hart, etc. during the HAVA stampede..

Do you know what kind of voting machines your county uses Ms/Mr California voter? If not, you can find out right HERE (thanks to Bowen’s office for posting this essential information on the Secretary of State’s website – DUH!)

Does your county use these machines?

Photo Sharing and Video Hosting at Photobucket

or these?

Photo Sharing and Video Hosting at Photobucket

or perhaps these?

Photo Sharing and Video Hosting at Photobucket

unethical types could be fiddling with this part of the very machine you vote on:

Photo Sharing and Video Hosting at Photobucket

So here’s what you need to do fellow Californians:

1) Once you’ve figured out which kind of machine your county uses HERE check to see if it’s on Bowen’s report  HERE.

2) If it is, you need to immediately call your County Clerk or Registrar of Voters who you can find HERE! or on this interactive state map. Tell them to support Debra Bowen’s statewide sweep of hackable voting machines and that you want secure, accurate, verifiable voting systems in your county. These public officials, unlike Congresspersons, rarely hear from constituents so your call can have huge impact on this crucial issue.

3) Then write a letter to your local paper/s using the Courage Campaign’s easy interface.

Remember everyone, the Republican governor has moved our primary to February (2/5/08 to be exact) so that California will have a big impact on the selection of the two major party candidates running for president. By coincidence (irony) CA GOP is busy trying to change our winner-take-all primary system (hmmm why would they want to do that?) Do we want the GOP deciding who our nominee is by fiddling with our voting machines as they continue their decades-long subversion of American democracy?

NOOOOOOOOOOOO!

Make sure your County Clerk isn’t giving Secretary of State Bowen any resistance as she works to fix the rigged voting machines in our Golden State. Feel free to also send Bowen a message of support!

And remember YOU DO HAVE THE POWER to change this government and this country. Here’s proof!

Bill Richardson Roundup: Week in Review

This was a significant week in Bill Richardson’s campaign for President, with a major address on climate change and how to end the bloodshed in Iraq.

It was also a significant week for peace and stability in Korea and Asia – which highlights Richardson’s expertise in foreign affairs and his diplomatic skills. With Richardson as President we get two for the price of one – a can-do leader on domestic issues and an experienced diplomat that knows how to bring people and nations together.

First, Richardson spoke in D.C. at the Take Back America Conference and set forth an unambiguous approach to Iraq – total withdrawal of U.S. forces combined with a diplomatic offensive:

But there is a fundamental difference in this campaign — and that’s how many troops each of us would leave behind. Other than the customary marine contingent at the embassy, I would leave zero troops. Not a single one. And if the embassy and our embassy personnel aren’t safe, then they’re all coming home too.

No airbases. No troops in the Green Zone. No embedded soldiers training Iraqi forces, because we all know what that means. It means our troops would still be out on patrol with targets on their backs.

A regional crisis is worthy of military intervention. A true threat to our country’s security is worthy of war. But a struggle between a country’s warring factions, where both sides hate the United States, is not worthy of one more lost American life.

Richardson also discussed his plan to addressing climate change:

I’m proud to have the most aggressive plan of anyone running for president. Within twelve years, my plan would reduce global warming pollution by 20 percent, lower demand for oil by fifty percent, and push fuel economy standards to 50 miles per gallon.

By the year 2040, my plan would require that 50 percent of our electricity be generated from renewable sources and would reduce greenhouse gas emissions by 80 percent.

You can read the plan for yourself at my campaign website or you can listen to the League of Conservation Voters. They rated it the most aggressive plan with the highest goals of any other candidate. These aren’t pie in the sky proposals, but they are ambitious.

If we can spend billions waging war in a country that never had weapons of mass destruction … then we can certainly find the will to stop the mass destruction of our planet.

It’s time that we as a nation chose the collective good over the desire to collect goods. And frankly, buying carbon offsets isn’t enough. Just like paying somebody else to go to church doesn’t make you religious … paying somebody else to conserve doesn’t make you a conservationist.

Earlier this year, Richardson visited North Korea and helped revive U.S.-North Korean negotiations on nuclear weapons issues.  During his April visit, North Korean leaders promised Richardson that they would meet with U.S. officials and representatives of the International Atomic Energy Agency to monitor the shutdown of North Korea’s nuclear reactor, in exchange for the U.S. unfreezing funds owned by North Korea and held outside the country.

In statement issued by the campaign, Richardson noted:

North Korean leaders made a promise to me to invite Assistant Secretary of State Christopher Hill to meet in North Korea. This high-level meeting comes on the heels of progress made toward shutting down the Yongbyon nuclear facility. Both of these actions are important steps in the process toward the denuclearization of the Korean Peninsula.

In an Op Ed published in The Hill, Richardson called on Congress to pass and fully fund the Voter Confidence and Increased Accessibility Act of 2007 in order to move America to a reliable and verifiable paper-ballot system now, and discussed efforts in New Mexico to adopt paper ballots:

In 2005 a grassroots coalition of concerned New Mexicans demanded action — and we acted. Working together with these citizens and the state legislature, I fought for legislation to increase voter confidence in our democracy through specific and concrete measures. We improved and standardized training for poll workers. We established statewide standards for provisional ballots to ensure that voters in low-income areas will not be disenfranchised. We made absentee voting fair, simple and uniform. And we established a random, statewide 2 percent audit of voting machines.

One year later, I signed a bill to move New Mexico to an all-paper-ballot system using optical scanners to count votes. We ended the hodgepodge of systems that confused voters and raised questions about reliability.

New Mexico’s conversion to a paper-ballot system made sense. Paper ballots are the least expensive, most secure form of voting available. . . .Using optical scanners meant quick and accurate results, while at the same time paper ballots became the permanent, verifiable, durable record of the vote.

Campaigning in Iowa, Richardson was asked to respond to John Edwards’ claim that he is more electable than Hillary Clinton and Barak Obama. Richardson noted that the Rocky Mountain and Southwest states were becoming increasing Democratic:

We in the Democratic Party seem to be nominating candidates that maybe are very strong in the East Coast and the far West Coast.  The only dispute I have with the senator’s perception is that I can deliver the Rocky Mountain states that other candidates can’t.

When questioned on his position on abortion rights, Richardson made clear his support:

Democrat Bill Richardson says that if he’s elected president, he would reject any Supreme Court nominees who believe Roe versus Wade should be overturned. . .  Richardson made the comment today in Des Moines, acknowledging that his stance probably upsets some people. Presidents typically say they don’t ask potential justices about their views on specific cases, but Richardson says he would make an exception for Roe versus Wade.

Another article on the question of abortion rights observed:

Richardson said he’d treat abortion rights differently than other issues because it’s so crucial to so many Americans. ‘‘I say this because we always dance around this issue,’’ said Richardson. ‘‘I’m also going to ask them, you do support civil rights, right? You do support a right of privacy, right?’’

By not directly discussing standards for picking nominees, Richardson said presidential candidates hide vital information from voters. ‘‘I would put men and women on the court who would shape policy for a generation,’’ said Richardson. ‘‘That’s the biggest legacy of a president. We’re already paying for the Bush legacy with these last few decisions on privacy and choice.’’

Questioned on his position on illegal immigration, Richardson stated:

I have to deal with this issue every day as the governor of New Mexico. There are four border states, and we are one of them. Am I for this wall? No. It’s a 10-foot wall. First of all, Congress didn’t fund the whole thing. And do you know what’s going to be built? Eleven-foot ladders.

Richardson criticized the new Senate energy bill passed by the Democrats as a Band-Aid approach that did not go far enough to curb our dependency on imported oil or spur serious technological innovation and promote renewable energy:

A haunting question hangs over the new energy bill passed by the Democratic-controlled Senate just before midnight Thursday: Would it work if it became law?

The real answer lies far in the future, but skepticism was rampant Friday. One prominent presidential candidate, New Mexico’s Democratic Gov. Bill Richardson, called it a “Band-Aid approach,” a sentiment expressed by other critics. Some called price-gouging provisions in the bill virtually meaningless, and President Bush has threatened to veto any bill containing such provisions.

Democratic leaders held out great promise for the legislation, saying it would reduce the nation’s reliance on foreign oil and help keep gasoline prices in check. “A giant leap forward,” Senate Majority Leader Harry Reid (D-Nev.) declared.

. . .In counterpoint to high Democratic praise in the Senate, Richardson, who served as energy secretary in the Clinton administration, said in a statement the bill did not go far enough and would not break U.S. dependence on foreign oil.

“It’s another Band-Aid approach, not the comprehensive medical treatment our nation’s energy policy needs,” he said. He called for a 50 m.p.g. fuel economy standard for cars instead of the 35 miles per gallon in the bill, which would have to be attained by 2020.

Richardson called for legislation that would incorporate the following elements as part of a comprehensive, integrated approach to climate and energy policy by 2020:

* Sharp incentives for making the plug-in car 50% of the auto market, giving consumers the option to fuel up at a fraction of the cost of gasoline;
*  A 50 mpg fuel economy standard for conventionally fueled vehicles, helping stimulate technologies that save fuel and save consumers gas money;
*  A 30% renewable energy requirement, which will help fuel our plug-in cars and will cause the retirement of dirty old coal plants;
*  A 20% improvement in energy efficiency across the board;
*  A climate change cap and trade program that auctions rights for industries and utilities to emit carbon at lower and lower levels — at least 20% less by 2020, and 80% less by 2040.

Finally, Richardson spoke on the importance of LGBT rights and Pride Month:

I am very pleased to join my friends in the GLBT community and Americans across the country in celebrating Pride Month. This month is a deserved commemoration of the contributions of GLBT Americans to the United States and a welcome symbol of how far we have come as a nation.

We must also acknowledge that we are in the midst of a difficult struggle for basic human rights and we have a long way to go. This month is a worthy symbol of our progress towards full civil rights for every American, but we cannot ignore the challenges we still must conquer before we can truly move forward and create a better society.

San Diego County Hates Clean Elections

(Missed the quick hit on this earlier, but it’s worth a full post)

In a particularly disheartening step towards making elections in San Diego a complete joke, the county has hired former Diebold sales representative Deborah Seiler as the new registrar of voters.  Diebold has “sold more than 10,000 of the machines to the county at a total cost of $31 million.”  Timed rather pugnaciously with Secretary of State Debra Bowen’s review of all the state’s voting systems, the article informs us that Seiler is “concerned” about potential decertification of voter machines.  Well, she should know right?  She sold them.  Former Registrar Mikel Haas, who’s since been promoted to a position overseeing the Registrar’s office (among others), insists her Diebold experience is a plus, saying “We use that system, so it’s kind of a plus.”

But w- w- w- w- wait it gets worse…

(Now Orange and Blue)

Making matters even worse is that this move just cements the all-corruption-all-the-time team at the San Diego County Registrar of Voters.  Last month, the Assistant Registrar of Voters position was handed over to Michael Vu, who, as the article reminds us, presided over Cuyahoga County, Ohio elections in 2004.  How did that go for him?  A court order forced the polls to stay open 90 minutes late and two election workers were convicted of rigging the vote (as Vu defended their innocence).  And so San Diego, your county has spoken.  Your votes should have as little chance of counting as possible.  Enough to warm the heart isn’t it? Or is that just the glow from the Constitution burning?

Now, there is the remote chance that these two people are not a lethal blend of evil and incompetent, but what are the real odds of that?  They both have records of being squarely on the wrong side of clean elections, and I have a hard time imagining that there’s literally nobody else available for this job who wouldn’t be an overt slap in the face to anyone who feels that voting should, perhaps, NOT be corrupt.  It isn’t as though San Diego has a particularly good record of late anyways.  Last year, protestors objected to irregularities such as voting machines being sent home with poll workers overnight before election day.  At the time Chairman of the Board of Supervisors Bill Horn explained “Nobody said that there was local fraud…Until I get a firm accusation of something illegal taking place, I don’t have a reason to have a public hearing.”

That, of course, was and remains complete crap.  Last year, the Board of Supes hid behind the SoS certification of voting machines as justification for not bothering to investigate potential problems (in addition to Horn’s blustering attempt at explanation).  And so now the integrity of San Diego County elections continues to circle the drain.  Here’s hoping that Debra Bowen carries a big stick when she reviews San Diego…she’s coming into the den of despotism.

Holt is Optimistic on Verified Voting Bill: ACTION!

(x-posted at dkos)
This article made my heart skip a beat (hattip to Chris Bowers at Mydd.com)

With Democrats controlling Congress, Rep. Rush Holt says he’s optimistic about achieving his longstanding legislative priority this year — requiring electronic voting machines to have paper backups so election results can be verified.

Yes folks, that’s right.

A total of 222 House Democrats and Republicans co-sponsored a similar bill Holt introduced in the previous Congress, when Republicans were in the majority, but it went nowhere. The legislation is widely expected to become law, with Democratic leaders tending to favor requiring a paper trail, analysts say.

A dirty little secret of the last congress it that Holt’s bill had enough support to pass, but Hastert would never let it onto the floor for an uppadown vote. We have a real chance to end these voting machine problems ONCE AND FOR all…

I agree with Chris when he said this today:

Whether or not you think election fraud has occurred via paperless DRE’s, the fact is that quite a few people don’t have confidence that their vote is counted accurately. According to Pew, only 39% of voters are “very confident” that votes are counted accurately nationwide. Among African-Americans, 18% are “not at all confident” that votes are counted accurately nationwide. This lack of trust in the political system can lead to significant voter retrenchment, which is bad both for progressives and for democracy.

And as a long time advocate of Verified Voting, (longer then I care to admit), all I have to say to that is: PREACH IT BROTHER!

I’ve written many, many, many diaries on Verified Voting, the dangers of centralized tabulation, GEMS and whatever else, i’ve written until my fingers felt like they were going to fall off.

I can’t think of any other issue that would give me greater pleasure then putting this business to rest immediately and for good, and THIS BILL WOULD DO THAT.

We are lucky here in California that some of our fine elected representatives, especially Senator Boxer have been major leaders in Verified Voting, but it never hurts to put the pressure on for truly bipartisan democracy saving measures such as this.

So take action now:
Use PFAW’s action item link to e-mail your rep about this now!

For the sake of party unity, for the sake of fair and clean elections, for the sake of Democracy itself.

ACTION: Diebold Fails Another Security Test — Demand Answers From S.O.S.

( – promoted by SFBrianCL)

(cross-posted at The Courage Campaign)

On Wednesday, the Center For Information Technology Policy at Princeton University released a report that proves that the Diebold Accuvote-TS voting machines can be easily infected with an untraceable malicious virus that steals votes and gives a result different than the true vote tally:

This paper presents a fully independent security study of a Diebold AccuVote-TS voting machine, including its hardware and software. We obtained the machine from a private party. Analysis of the machine, in light of real election procedures, shows that it is vulnerable to extremely serious attacks. For example, an attacker who gets physical access to a machine or its removable memory card for as little as one minute could install malicious code; malicious code on a machine could steal votes undetectably, modifying all records, logs, and counters to be consistent with the fraudulent vote count it creates. An attacker could also create malicious code that spreads automatically and silently from machine to machine during normal election activities — a voting-machine virus.

Go here for the full paper.

UPDATE: The video that accompanies the study is below:

I contacted Chuck Hahn, Assistant Secretary of State Policy & Planning to get Secretary of State Bruce McPherson's response to this latest indictment of the very technology that he himself certified for use in California's elections. Remember that McPherson certified Diebold even after a study that his very own office conducted found "serious flaws" in the Diebold software. His certification was "conditional" apparently on their insistence that they would fix the vulnerabilities.

At the CA GOP summer convention, I asked McPherson directly what reassurances Diebold had given him that these flaws would be fixed. He simply said "I wouldn't have certified them if I didn't think they were secure." And when I asked if there's anything online or in the public record that can reassure voters of Diebold's good faith efforts, he told me that they held public hearings that anyone could attend. That's when Hahn stepped in, gave me his card and asked me to give him a call and he swept McPherson away.

So in the wake of this new revelation I did call him and e-mailed him to make sure they were aware of the report and to get the Secretary's response. I received a return e-mail from Hahn not long after that, which, while swift, was still quite dismissive UPDATE:he prefers not to be on the record so I’ve taken down the text of the e-mail. He’s been helpful and responsive so far. Hopefully we’ll get a swift response from McPherson soon. This is about keeping pressure on him to answer for his decision to re-certify these machines. As I say in the comments, it appears from his certification announcement that CA may not even be using the machine tested. But that’s not the end of the story, nor is it the end of the explaining we must demand from McPherson.

CA-SOS McPherson Attacks with Lies

(Not only will Debra be, like, the coolest Secretary of State, EVER, but Bruce is a big fat liar. – promoted by SFBrianCL)

Schwarzenegger appointed California Secretary of State Bruce McPherson went negative against his opponent Senator Debra Bowen of the California Elections Committee last night when he sent out an email claiming that Sen. Bowen is funding her campaign with Wal-Mart stock.

So, how is it that the current Secretary of State, who is in charge of all of the official records – i.e. reporting for candidates and lobbying, how is it that he could have received such bad intelligence??Could McPherson just not find the right FPPC file?

I think Mr. McPherson must have used a DIEBOLD electronic search to get his information!  OOPSY!

McPherson sent this email to his supporters yesterday afternoon:

Accusing Senator Bowen of not only possessing Wal-Mart stock, but using that stock to fund her campaign for fair elections in California.

McPherson went so far as to make up a quote from Senator Bowen – saying

“I realize that makes me a hypocrite since it runs counter to my Democrat ideals but, hey – the ends will justify the means when I’m Secretary of State!” – Brucie Mc`P’ doing a really pathetic impression of Sen. Bowen

What Mr. McPherson failed to mention is that:
1.  Senator Bowen DOES NOT own Wal-Mart stock.
2.  If Senator Bowen DID own Wal-Mart stock – in California it is NOT permissible to loan stock to a campaign. (how does he not know this again?)
3.  Senator Bowen, unlike Mr. McPherson, has actually been voting in support of working people for the last 14 years – and is endorsed by the California Federation of Teachers, the California Nurses Association, AFSCME, the United Teachers of Los Angeles, and the State Council of Laborers.

Mr. McPherson, on the other hand – (according to Project Vote Smart a non-partisan, non-profit group that catalogues and tracks votes and rankings from various groups)
in 2003 had a 4% Rating with the California Labor Federation, AFL-CIO
in 2005 had a 20% rating with the California School Employees Association
Too:
McPherson approved Diebold voting equipment even after computer scientists declared the software possibly illegal and has security holes

Does this guy just not get it?

Or is he just bought and paid for by the right wing extremist machine to disenfranchise working people??

If asked these questions Mr. Mc “p” (now little “p”) might respond:

“I realize this makes a mockery of our voting system and our Constitution and runs counter to the ideals of every voter who cares their vote is counted accurately, but HEY – the ends justify the means when I certify the count!” -Me pretending to be Mc “p”

For goodness sake – CONTRIBUTE to stopping these lies!!  or use ActBlue and get some good government over there in California… ya’ll are killing me!! Little P frightens me!
