Greg Pettis, Cathedral City Councilmember for more than 13 years, former Cathedral City Mayor Pro-Tem, and Democratic Candidate for the CA 80th Assembly District has again and again shown his ongoing and indefatigable support for the issues that are important to the Lesbian, Gay, Bisexual and Transgender communities.  As indicated in earlier posts, Pettis is the only Candidate for the 80th AD, Democratic or Republican, to consistently and openly support Marriage Equality and Civil Rights for all members of the LGBT community.  His opponent Rick Gonzales and Richard Guttierez have stated in public forums such as Democratic Club Candidates’ forums that each would vote ‘nay’ on Marriage Equality.  Victor Manuel Perez has refused to indicate in public whether or not he would vote for Marriage Equality if elected and shied away from answering directly at the same forums (his surrogates say that Perez supports ‘gay marriage,’ but Perez has not indicated that he would ever vote ‘yea’ on Marriage Equality in the Assembly.  When his Campaign Director ‘informed’ members of the Desert Stonewall Democrats that Perez supported ‘gay marriage,’ members erupted in incredulity).

Pettis again showed his thorough support for the LGBT community by attending the Desert Business Association Mixer at the Desert AIDS Project tonight.  Pettis’ street cred in the LGBT community includes his long-standing membership in the Desert Business Association (http://www.dbaps.org/about_us.asp), the

Coachella Valley’s gay chamber of commerce, a network of gay and gay-friendly businesses, which have joined together to promote and support each other and to educate the community about the many services and products available through our gay-friendly stores, hotels, restaurants and other business ventures. The organization began in 1979, and over time, the DBA connected with mainstream Chambers of Commerce in the many business-oriented communities throughout the Coachella Valley.

Today, the DBA serves as a valley-wide business organization and new businesses are eager to affiliate, to participate in the m! any benefits of membership and to share in their responsibilities for networking with other business organizations and associations across the valley.

I received Press Releases from National Stonewall Democrats, the Sacramento Stonewall Democratic Club, and U.S. Representative Barney Frank regarding the decision by the Republican-dominated California Supreme Court overturning the ban on Marriage Equality in the State.

Sacramento Stonewall Press Release concerning the historic decision by the California Supreme Court is as follows:

Sacramento Stonewall joins in the celebration of today’s historic verdict.  The Supreme Court of California has decided in favor of equality.  Legal marriage is now the law of this state!  In just 30 days, gay and lesbian couples will be able to apply for marriage licenses.  

Bennett, President of Sacramento Stonewall said, “Full and equal recognition of our relationships means that we have crossed a final barrier toward full and equal citizenship, at least in California.  This day has been years in the making.  But we know we can’t celebrate for long.”

Bennett went on to describe the efforts of a small, vocal minority that has been organizing all Spring to deny us this basic human right.  According to Bennett, they spent some $2 million dollars to put a constitutional amendment on the November ballot to limit marriage.

Bennett said, “Today we celebrate.  Today we savor the full and equal recognition of our relationships, our families… and all the responsibilities that come with it.  But tomorrow we organize.   Our equality did not come easily.  We will not let it go.”

Legal Recognition of Marriage in CA

Washington, DC – Today, the National Stonewall Democrats expressed the organization’s support for a ruling today by the California Supreme Court which recognized the freedom of all California couples to marry.

“Stonewall Democrats welcomes the ruling of the California Supreme Court to legally recognize the freedom to marry. California voters have twice supported this position through their elected officials,” said Jon Hoadley, Executive Director. “In 2005 and 2007, Democratic control ensured that marriage legislation was successfully approved and passed to the Governor’s desk. Thanks to the tireless work of Stonewall Democrats chapters and other advocates across the state, the California Democrats strongly support the freedom of all California couples to marry. We must now turn our attention to protecting this landmark victory.”

In a ruling today, the California Supreme Court recognized that all California couples, including same-sex couples, are entitled to the legal recognition of marriage.

“Throughout California, Stonewall Democrats have strategically worked to build support for pro-equality positions among Democratic candidates, party officials and elected leaders,” said Laurie McBride (Sacramento, CA), Co-Chair of the Board of Directors of National Stonewall Democrats. “This ruling reflects the values of our Party and the will of California voters as already expressed twice by the state legislature. Democrats are working to support this court ruling and to defeat any proposed anti-marriage initiative.”

The efforts of Stonewall Democrats chapters across California ensured that the California Democratic Party first voiced its support for legislation recognizing the freedom to marry in 2005, with the party permanently ratified that position in its platform earlier this year. Their work created a political climate which included more pro-equality legislators, stronger advocates and diverse partnership opportunities for the crucial work of statewide groups.

In 2005 and 2007, the California legislature successfully passed the “Religious Freedom and Civil Marriage Protection Act” which would have recognized the freedom of all California couples to enter into civil marriage. Stonewall Democrats throughout California worked through their chapters to build support for the legislation among local Democratic bodies and the state party. Their efforts supported the work of partners like Equality California who successfully built a majority of support for the legislation in both the California Assembly and Senate. Although the “Religious Freedom and Civil Marriage Protection Act” was twice vetoed by the Republican Governor, chapters of the Stonewall Democrats continued to build Democratic support for the freedom of all Californians to marry.

FRANK APPLAUDS CALIFORNIA SUPREME COURT RULING ON SAME-SEX MARRIAGE

I want to offer to my friends in California both congratulations and reassurance:  I congratulate California’s Supreme Court for recognizing that all of California’s citizens are entitled to basic civil rights; and I can assure the people of the state that the result of this decision will be to improve the quality of life of tens of thousands of Californians who will now be able legally to express their love for each other, while having no negative effect whatsoever on the overwhelming majority of Californians who will choose not to marry someone of the same sex.  

As in California, Massachusetts’ experience with same sex marriage began with a 4-3 decision of our highest court.  There was initially some controversy.  Subsequently, after reality banished the concerns that many had expressed about the impact of this decision, our State Legislature voted by more than 3-1 to ratify the decision, and today, most people find it hard to remember that there was ever any serious fear about it.

The Greg Pettis for the California 80th Assembly District Campaign has announced that U.S. Representative Barney Frank (D-MA) will headline a fundraiser for the campaign on Saturday, May 24, 2008.  Pettis has served with distinction for more than 13 years on the Cathdral City Council, also serving previously as Mayor Pro-Tem, and is presently the leading Democratic candidate for the 80th AD.  Pettis was one of the first openly-gay electeds in the Coachella Valley and has solid support in the LGBT community amongst local, state, and National electeds.

Rep. Frank has served in Congress since 1981.  He is the Chairman of the House Financial Services Committee.  Previously, he was a Massachusetts State Representative and an assistant to the Mayor of Boston.   Frank has also taught at several Boston area universities.

In 1998, Frank founded the National Stonewall Democrats, the national gay, lesbian, bisexual, and transgender Democratic organization.  In 2004, and again in 2006, a survey of Capitol Hill staffers published in Washingtonian magazine gave Frank the title of the “brainiest”, “funniest”, and “most eloquent” member of the House.

As of May 2007, Frank is one of two openly-gay members of Congress, the other being Rep. Tammy Baldwin (D-WI), who has also endorsed Pettis for the CA 80th AD (see BlogActive.com for its listing of the closeted gay members of Congress who regularly vote to harm their own clan).

Frank’s blunt stance on outing certain gay Republicans has become well-publicized, dubbed “The Frank Rule” – that it is acceptable to out a closeted gay person, if that person uses their power or notoriety to hurt gay people.

Mayor Pougnet was elected to the Palm Springs City Council in 2003, and was elected its second openly-gay Mayor in November 2007.  Pougnet serves on numerous boards and committees, including President of the Mizell Senior Center, chairman of the Coachella Valley Association of Government’s Energy Conservation subcommittee, board member of the Valley Action Group, and a member of the Palm Springs Unified School District Advisory Committee.  He was also co-chair of the Citizens Task Force for Mountain and Foothill Preservation and Planning.

Pougnet lives in Palm Springs with his partner of 15 years, Christopher Green.  They became the father of twins, Beckham and Julia in April 2006.

Councilmember “Ma” Foat has been a businesswoman, activist and community volunteer in a variety of settings prior to and following her elections to Palm Springs City Council as its first openly-lesbian Councilmember.  In addition to Councilmember, Foat serves as Human Resources Committee Member of the Coachella Valley Association of Governments, Alternate to the Riverside County Transportation Commission, Member of the League of California Cities, Member of the Sub Committee on Neighborhood Involvement, Member of the Sub Committee on Convention Center Opening, and Member of the Sub Committee on Indian Oasis.

Councilmember Hutcheson was first elected to Palm Springs City Council in November 2007.  Hutcheson is a former-member of the Palm Springs Planning Commission, former-member of the Palm Springs Police Advisory Board, founding board member of the Old Las Palmas Neighborhood Organization, and former-member of the Citizens Advisory Committee for Community Development Block Grants in Palm Springs.

I just received this Press Release from Equality California regarding an effort of the Alliance Defense Fund (ADF) and the Advocates for Faith and Freedom (AFF) to prevent the enforcement of the Students Civil Rights Act (SB 777) that protects students from discrimination, harassment, and bullying in publicly-funded schools.

As a member of the Palm Springs Unified School District board of directors whose leadership is now in question due to the possiblity that the PSUSD and the school board may face sanctions due to their inability to meet academic standards, Gary Jeandron, must make his stand known regarding the enforcement of SB 777 and regarding discrimination, harassment and bullying of students.

Jeandron is also a declared candidate for the Republican nomination for the CA 80th Assembly District.  His website indicates that as a member of the School Board of Directors, Jeandron supervises a district with 22,000 students and an annual budget of $191 million.  Unfortunately, he did not use his position as a member of the Board to help students achieve academic standards or was unable to influence the Board in order to implement any plan that he formulated.  Now, the pressure is on Jeandron to indicate where he stands regarding SB 777 and its implementation.

AFF’s website states: “WHEN YOU PUT ON YOUR JESUS GLASSES, YOU CAN SEE THE TRUTH!”  The AFF is a non-profit law firm whose goal is ‘protecting our religious liberty in the courts.”  In other words, AFF’s intent is to help to implement a theocratic state where religion, their religion, dictates school policy.  Implicit in AFF’s policy statement is also the fact that they want their religious liberty protected and not the religious liberty of those who have differing faiths.  Great, faith-based law now.

The ADF is another so-called Christian organization that purports to defend Religious Freedom, Sanctity of Human Life, and Family Values.  Again, clearly a reference to what they perceive to be religious freedom, sanctity of human life, and family values.  They presume that only their view on these issues is the correct one and should be the prevailing one.  I thought that the religious culture wars ended centuries ago in Europe!

So, will Jeandron appeal to his radical right base and support the efforts of the AFF and the ADF and their attempts to develop a theocratic state based on their views of so-called Christian principles or will Jeandron support the right of students at every grade level to attend school and to live their lives without discrimination, harassment, and bullying?  Will Jeandron take a leadership stance that protects elementary, middle, and secondary school students from discrimination, harassment, and bullying because of perceived or actual sexual orientation.

Is it a family value that an elementary school student should continue to suffer discrimination because someone perceives that he or she might be gay or lesbian in the schools?  This is not my family value or that of a majority of Palm Springs residents.  Is it a family value that a middle school student should continue to suffer harassment because he or she is gay or lesbian?  That is not my family value and it is not the family value of most Palm Springs residents.  Is it a family value that a high school student is prevented from doing well academically because he or she is bullied at school and in the school yard because he or she is gay?  That is not my family or community value. What are Jeandron’s family values and are they diametrically opposed to those of most Palm Springs residents?  Does Jeandron believe that students ought to be able to study and to achieve academically without a hostile environment?

Seems like AFF and ADF fall into the category of bullies.  I wonder what the members were like on the school playground.  Just sayin’.

Equality California and GSA Network Move to Intervene in Lawsuit that Challenges Student Civil Rights Act, California Nondiscrimination Statutes

SAN DIEGO – Equality California and the Gay-Straight Alliance Network are seeking to intervene in a lawsuit filed by anti-gay organizations that would prevent enforcement of California statutes protecting students from discrimination, harassment and bullying in publicly-funded schools.

EQCA and the GSA Network today filed a motion to intervene in federal district court in San Diego to defend the California statutes that prohibit discrimination and harassment in publically-funded schools, including the newly-enacted Student Civil Rights Act (SB 777). EQCA was the official sponsor of SB 777, and both organizations actively supported the law. The two organizations are represented by the National Center for Lesbian Rights, Lambda Legal, the Transgender Law Center, the law firm Sheppard Mullin Richter & Hampton, LLP and the Law Office of David C. Codell.

“By enacting the Student Civil Rights Act, the Legislature and Gov. Arnold Schwarzenegger sent a clear message that California will not tolerate discrimination in our schools,” said EQCA Executive Director Geoff Kors. “This law protects all youth in our public schools. It helps prevent harassment and discrimination so students can learn free from threats and physical violence.”

The Student Civil Rights Act, authored by Sen. Sheila Kuehl, D-Santa Monica, reinforces existing California laws that prohibit discrimination in publicly-funded schools and activities, including discrimination based on religion, race, disability, gender and sexual orientation. California law has prohibited discrimination in public education on these bases including sexual orientation and gender – for years. SB 777 did not change the categories of discrimination prohibited by law, but merely updated the Education Code to clearly reflect current law so school administrators and teachers know their responsibilities to protect students without having to cross-reference other sections of state law.

“We’re intervening in this lawsuit because our student members advocated for SB 777 and are eager to defend it,” said GSA Network Executive Director Carolyn Laub. “Thousands of our members have endured daily harassment at school based on their sexual orientation or gender identity. It’s a shame there are adults who don’t think all students deserve to have a safe place to learn.”

According to the 2001 California Healthy Kids Survey, nearly 30 percent of California youth in grades seven to 11 report experiencing harassment or bullying based on their actual or perceived race, ethnicity, religion, disability, gender or sexual orientation.

“This law protects all students, plain and simple, irrespective of their race, religion, sexual orientation or gender identity,” said Lambda Legal Senior Staff Attorney Brian Chase. “With 200,000 of California’s school children every year finding themselves victims of harassment or violence, the need for this law is beyond argument.”

“Every student has the right to be safe at school,” said NCLR Legal Director Shannon Minter. “SB 777 simply makes this clear. The organizations bringing this suit are wasting taxpayers’ money and seeking to undermine common sense protections for all California students,” Minter said.

“The Transgender Law Center is proud of our Legislature for passing a bill that protects all of California’s students,” said Transgender Law Center Legal Director Kristina Wertz. “Education is dependant upon safe and constructive learning environments for all young people. All youth deserve to be treated with dignity and respect.”

California’s Legislature passed SB 777 in September and Gov. Schwarzenegger signed the bill into law on October 12.

The lawsuit challenging SB 777 was filed by lawyers for Advocates for Faith and Freedom and the Alliance Defense Fund last month in federal district court in San Diego.

WooHoo! We are almost as good as everybody else. I suppose the key word there is almost.  Equality California released their annual scorecard, and a record number of legislators scored a 100 by voting for civil rights.  In fact, 61 of of the 120 legislators scored a 100, all Democrats of course.

You can see the full scorecard here (PDF), but interestingly there were only 4 0s in the Senate, and 8 0s in the Assembly.  A lot of that can be attributed to the seeming lack of controversy surround Sen. Carole Migden’s SB 105, which allows “Simplifies the process of filing joint state income tax returns for registered domestic partners. Creates a worksheet California registered domestic partners will use to file jointly beginning with the 2007 tax year. ” IN other words, it’s a tax clean-up measure for a right (filing joint taxes) that was bestowed already.

Also getting many pro-LGBT votes was AJR 29, which  encourages the federal government to pass hate crimes legislation, specifically the Local Law Enforcement Hate Crimes Prevention Act.  I’m guessing that has to do with Republicans being ToughOnCrime^TM or something like that.

And the Governor, well he got an 88. It seems he mistakenly vetoed Marriage Equality, because I couldn’t possibly imagine our liberal, well-intentioned governor ever thinking that we don’t all deserve the freedom to marry the one we love.  Oh, right…he wants the “voters to decide”. Nice cop out, Arnold.

An above the fold story in today’s San Francisco Chronicle noted:

“This campaign is about changing the climate in California around this issue,” Seth Kilbourn, Equality California’s political and policy director, said as he sat in his upper Market Street office.

He cites polls showing Californians almost evenly split on the issue. A 2000 poll by the Policy Institute of California found that voters opposed same-sex marriage 55 to 38 percent; a poll by the same group last year showed a major shift: 48 to 46 percent.

This campaign is intended to move the state “over the tipping point,” Kilbourn said. “We wanted to connect to the people of California on an emotional level, on a level they can identify with.”

This powerful ad is going up Thursday and has substantial resources:

The Ring drive – which has received $400,000 from Jim Hormel, the San Francisco philanthropist and former U.S ambassador to Luxembourg; a $500,000 commitment from the Evelyn and Walter Haas, Jr. Fund; and $500,000 from an anonymous donor – “is gently challenging the people of California to imagine what it would be like if they couldn’t get married to the person they loved.”

Legal rights and benefits, many of which are covered by domestic partner laws here and in other states, are important, Kilbourn added, but this campaign aims at the heart.

“It’s putting the people we’re trying to talk to, the undecided people, into our shoes. We gave them something they can identify with, a wedding. The ad firm really felt that if you’re going to try to connect with a certain group of people, you need to talk about them, not yourself.”
